The New Patent Frontier under the America Invents Act Has Arrived: File Early, File Often, or Just Stay Home?

The final, and perhaps most substantial, piece of the America Invents Act (“AIA”) was implemented in March of 2013, with the first-to-file rules for new patent applications coming into effect in the United States. This significant change brings the U.S. into close “harmony” with the rest of world on the patent playing field, and it will have a profound effect on how companies file, prosecute and enforce their intellectual property rights going forward.
