Unlike other forms of intellectual property, there is generally no Federal protection for trade secrets. The Defend Trade Secrets Act of 2016, now progressing through Congress with bipartisan support, aims to change that. Although it bears many similarities to existing trade secrets laws, it has critical differences that trade secret owners and legal practitioners should know about.
