The last year has continued to show a new awakening by the Supreme Court in the patent area, generally reflecting public sentiment raising concerns about patents and their perceived impact.  Recent Federal Circuit decisions have struggled to apply new precedent from the Supreme Court, with mixed success. 


This presentation will provide an overview of recent Supreme Court and Federal Circuit decisions and their impact on patent prosecution and litigation in each of the following areas:



  • 35 U.S.C. §101
  • 35 U.S.C. §145
  • Orange Book and Use Codes
  • Injunctions after eBay
  • Inequitable Conduct after Therasense
  • Doctrine of Equivalents

  • Exceptional Case and Patent Enforcement
