“Chairman, That Patent Should be Revoked!” – Join the EPO Opposition Mock Workshop and Help Argue the Case

MBHB partner Dr. Donald Zuhn is the featured moderator for a BIO 2014 session entitled, “Chairman, That Patent Should be Revoked!,” set to take place from 4:15-5:15 p.m. on Wed., June 25.

Description

Anyone can challenge the validity of a patent granted by the European Patent Office (EPO), provided they do so within nine months following the publication of the patent and pay a fee of EUR 745 (US$ 995). The system helps ensure high quality patents in Europe. This session offers insight into the EPO’s opposition proceedings and a comparison with the recently introduced U.S. Patent & Trade Office inter partes and post-grant reviews. Three EPO examiners will conduct realistic proceedings and decide on the fate of a contested illustrative patent. European patent attorneys will represent the proprietor and defendant and put forth their positions. Attendees can join either party and help debate the case.

Key Takeaways:

  • Identify how opposition proceedings are conducted within the EPO
  • Explore how the validity of a patent is determined
  • Identify the differences in EPO proceedings compared with the U.S. process
