Several recent Federal Circuit decisions have made it challenging for licensing professions to keep up with the doctrine of patent exhaustion. In addition, district court cases addressing the issue have been unpredictable. Given that doctrine of patent exhaustion can critically impact the value of any patent license, it is important for patent and license drafters to account for the several nuances that have arisen in the recent decisions. The webinar is intended to provide a in depth review of several recent decisions, to outline their differences, and to provide guidance regarding how to address the impact of the decisions in license agreements.
