The presenters will discuss the recent case that Eli Lilly has brought against the Canadian government under NAFTA. Lilly alleges that Canada improperly denied patent protection for two drugs based on Canada’s “promise” doctrine. The presenters will then explore the issues more broadly, focusing on differences in U.S., Canadian and European practices relating to patenting of pharmaceutical products.
