Who do I enforce against, what is the cause of action, where do I pursue enforcement, when do I begin enforcement proceedings, and above all, why do I choose a specific enforcement route? The answers to each of these questions may and likely will change each time a new decision comes out of a country’s high court or each time an international organization seeks to restructure their approach for enforcement. Moreover as both the legislative bodies of countries worldwide and international IP and trade organizations seek to adapt their intellectual property regimes to evolutions in technology, IP owners must look to modify their approaches to enforcement accordingly. This session will review some recent developments in cases, laws and harmonization efforts and discuss how companies should take these changes into account when developing their own IP strategies. In particular, the program will discuss:




  • The implications of recent and upcoming U.S. Supreme Court decisions such as TC Heartland and Oil States Energy Services


  • The implications of Brexit negotiations and the current EU efforts on IP enforcement modernization


  • The implications of current international trade negotiations and agreements
