Who do I enforce against, what is the cause of action, where do I pursue enforcement, when do I begin enforcement proceedings, and above all, why do I choose a specific enforcement route? The answers to each of these questions may and likely will change each time a new decision comes out of a country’s high court or each time an international organization seeks to restructure their approach for enforcement. Moreover as both the legislative bodies of countries worldwide and international IP and trade organizations seek to adapt their intellectual property regimes to evolutions in technology, IP owners must look to modify their approaches to enforcement accordingly.
